MapInfo reserves the right to refuse registration of or cancel a MapInfo User ID in its sole and absolute discretion. You are responsible for maintaining the confidentiality of your MapInfo User ID, and you agree to immediately notify MapInfo of any unauthorized use of your MapInfo User ID.

8. Indemnity

You agree to indemnify, and hold MapInfo, its parents, subsidiaries, affiliates, officers and employees, harmless, from and against any claim, demand, damages, loss, liability, costs or expenses, including attorneys fees, arising out of or in any connected with your access to the Site, your use of the Services, any violation of this Agreement by you, or the infringement by you, or any third party using your account, of any intellectual property or other right of any person or entity.

9. Limitation of Liability

IN NO EVENT SHALL MAPINFO BE LIABLE WITH RESPECT TO THE "SITE" OR THE “SERVICES” (i) FOR ANY AMOUNT IN THE AGGREGATE IN EXCESS OF THE FEES PAID BY YOU FOR ACCESS TO THE SITE OR USE OF THE SERVICES OR (ii) FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU. This Agreement shall be governed by and construed in accordance with the laws of the state of New York without regard to its conflict of laws rules. MapInfo and you consent to personal jurisdiction of the state and federal courts sitting in Albany, New York. MapInfo and you also waive trial by jury in any action, proceeding or counterclaim brought by either of the parties against the other on any matters whatsoever arising out of or in any way connected with these Terms of Use.
